Abstract:
The Asylum Procedures Directive as well as the Law on asylum of 29 July 2015 display the ambition to increase procedural guarantees. But this ambition has to be confronted with the practice, particularly with regard to the implementation of the right to asylum for migrants deprived of their liberty in detention center for illegal migrants. Indeed, asylum seekers in detention center for illegal migrants, subject to a deportation order and deprived of their liberty, can be particularly affected by the administration’s research of efficiency in implementing removal order, at the expense of their right to asylum.
