Abstract:
EN: The book focusses on the legal issues arising at the moment of the reception by a State of an asylum seeker. The regulations of immigration and the legal status of foreigners who “escape” from their own country for different reasons is examined in order to better understand the legal differences between the refugee status, the stateless status and the international and subsidiary protection of the foreigners and how they can differ in different legal orders. A peculiar attention is devoted to the right to asylum as it is defined by the international regulations as well as by the Italian Constitution - that declares "asylum" as one of its fundamental principle - and how it deals, nowadays, with the increasingly affirmation of the sovereignty of the States. The differences between the arising of a human right once defined as "ius peregrinandi" and its more recent legal boundaries that lead to a more restrictive definition of a "ius migrandi" is examined. Each Member State manages its external borders not only to control access to its own territory but also to control access to the Schengen area as a whole: a Member State acts in the interest of the others Member States, too, and it “carries out a service on behalf of the EU” (EU Commission, COM (2011) 248, 7). Moreover, a Member State cannot ignore the need to respect individuals’ fundamental rights as every individual’s freedom to leave any country, including their own, is recognised at the international and EU legal system level (Universal Declaration of Human Rights, art. 13, par. 2; International Covenant on Civil and Political Rights, art. 12, par. 2; ECHR, Protocol no. 4, art. 2, § 2, art. 3, § 2). This reflects what has been defined as a contrast between universalism and “fragmentation” which leads to the recognition of rights regardless of a citizenship status and therefore of a national identity. The purpose at the EU level of guaranteeing equal protection to forced migrants is certainly a common aim but the alleged universality - even geographical – of human and civil rights as a matter of fact is limited by the administrative organizational structure of each Member States. Indeed, the national models of administrative protection not always give full satisfaction to the migrants’ rights. The administrative efficiency of a Member State along with the increasing need of safeguarding of internal security measure the real level of the guarantee of the human and civil rights of the forced migrants, who are hosted in devoted reception centers usually managed – in Italy - by social services providers. Indeed, the equality principle encounters different outcomes related to the MSs’ administrative system and their possible systemic crisis. IT: La monografia indaga la disciplina dell'accoglienza e del trattenimento dei migranti involontari. Partendo da una ricostruzione della nozione di diritto di asilo esamina la disciplina amministrativa e i limiti opponibili all'ingresso e al soggiorno di quanti vantino una pretesa di protezione verso uno Stato ospite. Senza dimenticare l'analisi delle limitazioni amministrative dovute a ragioni di igiene e di sanità pubblica approfondisce la disciplina della tutela del migrante al momento dell'accesso o approdo sul territorio di uno Stato membro dell'Unione europea, di cui offre un'approfondito esame anche secondo i profili dell'ordine pubblico, della sicurezza pubblica e della sicurezza dello Stato con particolare attenzione all'ordinamento italiano e senza dimenticare i profili di rilievo del diritto dell'Unione europea. Nel delineare i tratti salienti della distinzione tra accoglienza e trattenimento si sofferma sulla gestione amministrativa dei centri d'accoglienza dei migranti involontari senza dimenticare i c.d. hotspot. Il lavoro si sofferma poi sulle procedure di riconoscimento degli status di protezione internazionale e di concessione della protezione umanitaria cui si affianca il riconoscimento dello status di apolidia, indagando anche sulla possibile configurazione di profili di responsabilità civile e amministrativa della pubblica amministrazione a fronte del fenomeno della migrazione involontaria.
