Morocco's migration policy
the legal situation of immigrants in Morocco

Brief description:

The subject of this thesis is the challenge posed by migration. In this context, Morocco, like many other countries, is seeking to maintain a balance between often contradictory objectives. Indeed, international standards calling for unrestricted respect of human rights, and which are generally in favor of the social and economic integration of migrants, are very difficult to apply in a country that lacks the means to guarantee the reception of migrants. This observation invites us to explore the various dimensions of Moroccan migration policy, highlighting the strategies adopted, the players involved and the consequences of these choices for migrants and Moroccan society. The main ideas of this undertaking are therefore based on a set of questions whose objective is to find out how Morocco's migration policy has evolved, and how this evolution is influenced by internal (economic, social, political) and external (international cooperation, regional pressures, etc.) factors. Moreover, the country has found itself, against its will, playing the role of mediator without a clear mission, between emigration countries (Sub-Saharan Africa) and immigration countries (EU). This very complicated situation requires Morocco to take the right decisions in managing migratory flows, particularly in terms of regularization, protection of migrants' rights and national security. The report on migration in Morocco refers to official sources, the most important of which are Law 02-03 on the entry and residence of foreigners in Morocco, and the 2021 report by the Ministry of Foreign Affairs on immigration and asylum.

Methodology:

The methodology followed in the preparation of this thesis is a qualitative approach based on the interpretation and description of non-numerical data taken from the bibliography. The discourses, narratives and interpretations of the actors involved in migration policy will be necessary for the analysis of the country's migration management strategy. A comparative analysis of the latter with other countries in the Mediterranean region will also be undertaken to identify Moroccan particularities as well as good practices and lessons to be learned, particularly in terms of collaboration between Morocco and certain major European Union countries such as France, Germany, Spain or Italy. A large part of this research will also be devoted to the Morocco-African relationship in terms of migration governance. Indeed, given Morocco's geographical position, it would be necessary to conduct a major research project preparing Morocco to be a short-term destination country for African migrants. The originality of this work would be to highlight the prospect of Morocco developing through inter-African cooperation in terms of good governance of migration.
