Brief description:

L’objectif de ce travail de recherche est de déterminer si l’Union européenne doit faciliter l’entrée légale des personnes dans le besoin d’une protection internationale sur son territoire, et si elle le peut, autrement dit, si elle dispose d’une capacité transformative en la matière. En réponse à cette problématique, ce travail entend révéler l’existence d’un droit d’accès à l’asile dans l’Union européenne, et plus particulièrement dans l’espace de liberté, de sécurité et de justice, avant d’en étudier le régime. Ainsi, la valeur ajoutée de ce travail sera celle de l’identification d’un droit fondamental à avoir accès à un lieu de refuge, à travers l’articulation entre les normes pertinentes (droit international des réfugiés, droit européen et international des droits de l’homme et droit de l’asile de l’Union européenne) et sa garantie dans l’Union.

The aim of this research is to ascertain whether the European Union must facilitate the legal entry of protection seekers on its territory, and whether it can do so; in other words, whether it has the required transformative capacity. In response to this question, this work intends to reveal the existence of a right to access asylum in the European Union, particularly in the Area of Freedom, Security and Justice, before studying the regime of this right. Thus, the added value of this work will be the identification of a fundamental right to access a place of refuge, through the articulation of the norms at stake (International Refugee Law, European and International Human Rights Law and EU Asylum Law) and its guarantee in the EU.

El objetivo de este trabajo de investigación es determinar si la Unión Europea debe facilitar la entrada legal de las personas que necesitan protección en su territorio, y si lo puede, en otras palabras, si tiene una capacidad transformativa al respecto. En respuesta a esta pregunta, este trabajo se propone revelar la existencia de un derecho de acceso al asilo en la Unión Europea, y en particular en el espacio de libertad, seguridad y justicia, antes de estudiar su régimen. Así, el valor añadido de este trabajo será el de la identificación de un derecho fundamental de acceder a un lugar de refugio, a través de la articulación entre las normas pertinentes (Derecho Internacional de los Refugiados, Derecho Europeo y Internacional de los Derechos Humanos y Derecho de Asilo de la Unión Europea) y su garantía en la Unión europea.
