Eine Untersuchung mit Fokus auf dem Gemeinsamen Europäischen Asylsystem (An Analysis with Special Focus on the Common European Asylum System)

Brief description:

In recent years, the principle of solidarity in the EU has increasingly entered the public debate. However, the legal implications of this principle are still largely unclear and subject of widespread debates. The project primarily aims to make a dogmatic classification of this principle. In particular, my focus lies hereby on the solidarity provisions in the CEAS.
Therefore, the question of the dimensions of this principle will be addressed and described on the basis of an analysis of the already existing solidarity instruments at the level of secondary law, such as the Relocation Decisions or the Temporary Protection Directive or the solidarity provisions in the Dublin III Regulation. The solidarity provisions of the asylum and migration package proposed by the Commission and the different types of solidarity will also be examined in more detail, especially with regard to their "solidarity content" and possible regulatory gaps. Furthermore, the question will be discussed whether a crisis-driven interpretation of the solidarity principle is sufficient and in line with EU primary law, or whether there is a need for amendments on the part of the EU legislator towards a more sustainable solidarity concept.
