The emigrant is a little-known figure in public law. For a long time, the immigrant was the focus of attention, and in particular the way he or she was treated by the French, European and international legal systems. Yet emigration remains a mass phenomenon, with the latest studies estimating the number of French nationals living abroad to be at least two million. This thesis project aims to contribute to the construction of the legal status of the emigrant, based on a collection of legal data from national, European and international law, as well as comparative law. Surprisingly, no exhaustive analysis has yet been undertaken in public law of the emigrant and the phenomenon of emigration. And yet, the subsistence of the legal link that continues to bind an individual residing abroad to his or her State of nationality is a major issue of public law. Emigrants retain their nationality, their citizenship, and thus participate, at least indirectly, in the adoption of laws for which they are not the intended beneficiaries, and even have special representative bodies in France and abroad. Taken as a whole, this is evidence of true "external" citizenship. The aim of this thesis project is to examine the legal structure designed to maintain and organize relations between a state and its emigrants.Methodology:
