New Article: “European Commission v. Hungary (Reception of Applicants for International Protection II) No. C-123/22”

Our Member, Dr Tamás Molnár, Project Officer at Justice, Digital and Migration Unit of the Fundamental Rights Agency, has recently published an article: “European Commission v. Hungary (Reception of Applicants for International Protection II) No. C-123/22” in the American Journal of International Law.

The Article critically analyses the CJEU judgment on Hungary’s persistent non-compliance with EU asylum and return law. As the first ruling under Article 260(2) TFEU in this field, it highlights the constitutional and enforcement significance of imposing unprecedented financial sanctions for not complying with a previous judgment of the Court. The author also thoughtfully examines the issue from an international law perspective.
