Our Odysseus member Iris Goldner Lang (University of Zagreb), Jean Monnet Professor of EU Law, has published a paper on “EU Values as a Shield and a Sword in EU Migration and Asylum Law”.
The paper examines how EU values are invoked both to protect third-country nationals’ human dignity, non-refoulement, and fundamental rights, and to justify their integration duties and restrictive border policies. It argues that both approaches are legitimate provided they respect the constitutional “red lines” that must not be crossed, and that equal standards concerning respect of EU values apply to both EU citizens and third-country nationals.
