Following the Council’s adoption of the Return Regulation on 1 October, we are pleased to share the article of our member from Romania Madalina Moraru, published today in open access in the German Law Journal: “Reforming the EU Return Acquis through ‘Exceptionalized Pluralism’: From Internal Borders to Offshore Enforcement”.
The article considers the 2024–2026 reform as a multiplication of derogatory return tracks that displaces the Charter-based safeguards the CJEU developed under the Return Directive. It examines the merged asylum–return procedure, internal-border transfers, the European Return Order, expanded pre-removal detention and return hubs. It also notes that the hub provisions apply a full year before the procedural ones.
